Terms and Conditions

This document sets out the terms and conditions under which you may use the lightfaber.eu website (the “Website”).
The Website is owned and operated by Darling Acoustics SRL, headquartered at Comuna Budești, Sat Barza, nr. 11, Vâlcea County, Romania, registered with the ONRC under no. J2015000293387, VAT no. RO34545010 (hereinafter “LIGHT FABER” or “Darling Acoustics SRL”).

Please note that we reserve the right to change, modify, add to, or remove portions of these Terms at any time, without notice. Unless stated otherwise, such changes take effect immediately upon posting. Please review these Terms periodically. Your continued use of the Website after any changes are posted constitutes your acceptance of those changes.

Please read these Terms carefully when accessing the Website, as they apply to any use of the Website. By accessing the Website, you confirm that you accept these Terms and agree to comply with them. If you do not agree, you may choose not to use the Website. All information on the Website is of a general nature and applies to all persons who access it (hereinafter, the “Users”).

Definitions

For the purpose of this Policy, the following terms shall have the meanings set out below:

  • Website / Platform – The domain www.lightfaber.eu and its subdomains, including but not limited to the public site and its subpages.
  • Account – The combination of an email address and password that allows a single Client to access restricted areas of the Website through which the Service is accessed.
  • Client – Any natural person or legal entity, public or private, that places an order via the Website after creating an Account.
  • Distance Contract – Any contract concluded between a professional and a consumer within an organized distance sales or service system, without the simultaneous physical presence of the parties, using exclusively one or more means of distance communication up to and including the time the contract is concluded.
  • Content – All information on the Website that can be visited, viewed or otherwise accessed by using electronic equipment.
  • Transaction – The collection or refund of an amount resulting from the sale of a product by LIGHT FABER to a Client, via LIGHT FABER’s approved card payment processor, regardless of delivery method.

Important: Transactions may take place only within the European Union. Deliveries to addresses outside the EU are not accepted for orders placed via www.lightfaber.eu.

1. Intellectual Property Rights

1.1. The design and presentation of the Website, including its settings, menus, submenus and functionalities, are the property of Darling Acoustics SRL.
1.2. The Website, trademarks, logos, slogans, texts, images, databases and all other materials and components of the Website are the property of Darling Acoustics SRL or its partners and are protected by applicable Romanian and international intellectual property law.
1.3. Reproduction, distribution or publication, in any form, of the Website content and elements displayed on the Website is prohibited without the prior written consent of Darling Acoustics SRL.
1.4. Any attempt of any kind to modify the images or information on the Website by any person other than Darling Acoustics SRL, as well as the creation of misleading links to Website pages, entitles Darling Acoustics SRL or any other lawful rightsholder to seek all appropriate remedies before the competent courts. Nothing on the Website shall be construed as granting any license/right to use any registered trademark displayed on the Website without prior written permission from Darling Acoustics SRL.
1.5. You may not transmit to this Website, or to the email addresses listed on it, any material that is illegal, dangerous, defamatory, obscene, pornographic or vulgar, or that could be considered as inciting unlawful acts.

2. Use of the Website

2.1. Access to the Website is free of charge. Darling Acoustics SRL does not guarantee that the Website will be available at all times without interruption and may suspend, withdraw, discontinue or modify the Website in whole or in part without prior notice.
2.2. Darling Acoustics SRL shall not be liable if the Website cannot be accessed, regardless of the reason or the duration of such unavailability.
2.3. Users are responsible for taking all steps necessary to access the Website and for ensuring that all persons who access the Website via their internet connection are aware of and comply with these Terms and any other applicable conditions.
2.4. Anyone seeking details about the products or services shown on the Website is invited to contact Darling Acoustics SRL’s representatives regarding availability and contractual conditions. Access to products and services described on the Website may be restricted for certain persons or in certain regions/countries. No product or service will be supplied where Romanian law prohibits it.

3. Online Sales Policy

3.1. Users who have or create an Account may place and pay for orders through the Website. The online shop will honor only those orders with delivery addresses within the European Union.
3.2. Sharing an Account among multiple Users is prohibited. If such actions are discovered, Darling Acoustics SRL reserves the right to cancel or suspend Website access or to suspend/close the Account.
3.3. Darling Acoustics SRL may publish information on products and/or promotions run by it or by third parties with whom Darling Acoustics SRL has partnership agreements, for specific periods and while stocks last.
3.4. Products purchased via the Website are intended exclusively for the Client’s personal use.
3.5. Darling Acoustics SRL may limit the ability to purchase certain products or services on the Website at any time for one or more Clients.
3.6. All prices for products or services presented on the Website are expressed in EUR and include VAT.
3.7. Prices shown with a strikethrough indicate the initial sale price before the discount.
3.8. Invoicing is in RON for Clients in Romania and in EUR for Clients in the rest of the EU. Accepted payment methods are:

  • Online by bank card
  • Bank transfer (payment order)

3.9. For online payments, Darling Acoustics SRL is not and cannot be held responsible for any additional costs incurred by the Client, including but not limited to currency conversion fees charged by the card-issuing bank; the Client bears sole responsibility for such costs.
3.10. In product/service descriptions, Darling Acoustics SRL may depict other items (e.g., accessories) that are not included in the product price. Images are illustrative; delivered products may differ (color, accessories, appearance, etc.) due to external factors such as lighting.
3.11. Darling Acoustics SRL reserves the right to change prices for products available on the Website prior to order placement, without prior notice to the Client.
3.12. The purchase price is the price applicable at the time the order is placed, subject to stock availability.
3.13. The purchase price of promotional products is the price applicable at the time of order, subject to stock availability and/or the promotional period if defined.
3.13.1. During promotional campaigns, gift/discount vouchers (including newsletter vouchers) cannot be applied at checkout.
3.13.2. Gift/discount vouchers are valid for a maximum of 12 months from issuance.
3.14. The purchase price of products in a submitted order cannot be changed later except by mutual agreement.
3.15. By completing an order, the Client agrees that Darling Acoustics SRL may contact them, as applicable, in order to:

  • Inform them of card-issuer rejection of the transaction (card payments);
  • Inform them of payment processor invalidation (card payments);
  • Validate product availability and quantities within 48 hours of order placement;
  • Validate the order value (including value-added services such as shipping);
  • Agree on delivery details.

3.16. Darling Acoustics SRL may automatically cancel an order, without liability for either party, where:

  • The card issuer rejects the transaction (online payment);
  • The payment processor invalidates the transaction (online payment);
  • The Client provided incomplete or incorrect data on the Website;
  • The Client’s activity on the site may cause or causes damage of any kind to Darling Acoustics SRL and/or its partners.

3.17. If the Client chose card payment at checkout, after order validation the Client must enter the data required to process the payment.


3.18. Order flow:

  • The Client selects products and adds them to the cart;
  • When ready to order, the Client selects “Buy”;
  • The Client selects the payment method and provides the requested data (additional data may be required for card payments);
  • The order is processed and prepared for delivery.

3.18.2. If, upon order confirmation, the Client finds that some ordered products are unavailable, the Client may cancel the order, proceed without the missing products, or add other products (which will constitute a new order following the steps above).
3.18.3. Once the order value is validated (or Darling Acoustics SRL informs the Client that the order is validated), the order becomes a Distance Contract, pursuant to Government Emergency Ordinance no. 34/2014 on consumer rights.
3.18.4. Clients may also place orders by telephone.

3.19. Shipping

3.19.1. Darling Acoustics SRL will include in the parcel all documents necessary to evidence the purchase.
3.19.2. Darling Acoustics SRL will keep the Client informed of the status of the order/contract.
3.19.3. Shipping method: courier (related fees will be communicated).
3.19.4. Minimum delivery fee: 25 RON. The delivery cost is shown at checkout.
Attention: Delivery is made only to an adult, upon presentation of an identity document.
3.19.5. Deliveries are made only within the European Union, typically within 20 days of order confirmation and not exceeding 45 days. If a product cannot be delivered, Darling Acoustics SRL will inform the Client and refund any amounts paid within 14 days.

3.20. Quality and Warranties

3.20.1. Certain products may benefit from a contractual warranty, as specified on the product page at the time of sale on lightfaber.eu. No Client may claim a warranty beyond what is expressly stated.
3.20.2. Darling Acoustics SRL does not guarantee stock availability for any product listed for sale on the Website.

3.21. Returns and Withdrawal

3.21.1. Any Client may return products purchased via the Website in the following cases:

  • Parcels/products show severe damage;
  • Wrong products were delivered.

To submit a complaint regarding delivered products, the Client must contact Darling Acoustics SRL in writing at contact@lightfaber.eu, or via another method that confirms receipt, within 3 days of receipt of the products. Darling Acoustics SRL will review the complaint and, if justified, will remedy the situation as soon as possible.

For products showing manufacturing defects upon receipt, or where a product different from the one ordered was delivered, Darling Acoustics SRL will either replace the product(s) at no additional cost or refund the product price within 14 days of receiving the returned product.

If products were ordered with incorrect sizes/thicknesses, Darling Acoustics SRL will replace the product. If an identical product is unavailable, the Client will receive a refund of the product price within 14 days of receipt of the return. Replacement is subject to the conditions and limits of a standard order.

Fees for additional services, including but not limited to shipping, are non-refundable. In all cases, return/reshipment costs are borne by the Client.

3.22.2. A consumer Client has the right to withdraw unilaterally from the distance contract—without penalties and without giving any reason—within 14 calendar days from the date of taking possession of the product, in accordance with Government Emergency Ordinance no. 34/2014.
According to the applicable legislation, a consumer is any natural person or group of natural persons organized as associations as defined in art. 2 point 2 of Government Ordinance no. 21/1992 on consumer protection, as amended.

3.22.3. To exercise the right of withdrawal, it is sufficient for the Client to send a withdrawal declaration to our company by any means, followed by our prompt confirmation of receipt by email to the address indicated by the Client.
3.22.4. The Client must notify Darling Acoustics SRL of the intention to return the products, by any written means (e-mail, etc.), within 14 working days of receiving the products.
3.22.5. The Client is responsible for ensuring that the referenced products are returned to Darling Acoustics SRL within 14 calendar days from sending the withdrawal notice; otherwise, the right of withdrawal no longer applies and the request will be considered invalid.
3.22.6. Products cannot be returned—and no damages/compensation claimed—if the returned product is not in the same condition as delivered (original packaging, all labels and seals intact, accompanying documents included, and no signs of use).
3.22.7. Under GEO no. 34/2014, Darling Acoustics SRL reserves the right not to accept returns for products which, by their nature, cannot be returned or may deteriorate or expire rapidly.
3.22.8. Where the product price is refunded, reimbursement will be made within 14 days from the date we are informed of the consumer’s decision to withdraw. For card payments, the amount will be returned to the same bank account used for the transaction.
3.22.9. Darling Acoustics SRL is not required to refund additional delivery costs where the Consumer explicitly chose a delivery type other than the standard delivery offered by the Seller. Darling Acoustics SRL may delay reimbursement until the goods that were the subject of the sale are received.
3.22.10. If returned products show signs of wear, scratches, impacts, mechanical or electrical shocks, missing accessories or missing warranty certificates, Darling Acoustics SRL reserves the right either to accept or refuse the return, or to withhold 0–50% of the product value to cover restoration costs. If the product is damaged or the packaging unsealed, a surcharge of 0–50% of the product value may be applied; this amount will be deducted from the initial payment.

4. Warranties and Liability

4.1. Use of the Website is at the User’s sole risk.
4.2. Darling Acoustics SRL shall not be liable for any damage caused by a virus, denial-of-service or distributed denial-of-service attack, or other technologically harmful material that may infect the User’s computer, IT system and/or data as a result of accessing the Website or third-party websites linked from it. Links are provided for convenience only; Darling Acoustics SRL assumes no responsibility for the content, products, or services of those websites, nor for websites linking to this Website. Such links must not be interpreted as an endorsement.
4.3. Darling Acoustics SRL reserves the right at any time to remove temporarily or permanently any Content or parts thereof. The User acknowledges that Darling Acoustics SRL shall not be liable to Users or third parties for such suspensions or interruptions.
4.4. Darling Acoustics SRL assumes no responsibility for any interruption or omission regarding internet/network/hosting services.

5. Links to Other Internet Resources

5.1. The Website may contain “LINK” references to other internet resources/pages. The User acknowledges that Darling Acoustics SRL cannot be held liable for the operation of such external resources.
5.2. Darling Acoustics SRL has no obligation to verify the information and content contained in the external resources mentioned.

6. Changes to the Website Content

6.1. Darling Acoustics SRL reserves the right to modify the structure and/or content of the Website at any time, without prior notice.
6.2. Darling Acoustics SRL makes every effort to provide Users with up-to-date and accurate information and to present all information on the Website clearly and concisely, and will use reasonable efforts to correct any errors. Additional information about currently available products and services can be obtained from Darling Acoustics SRL representatives and/or via the contact details provided on the Website.
6.3. Darling Acoustics SRL shall not be liable for direct or indirect damages arising from errors, inconsistencies or inaccuracies on the Website not attributable to its fault, including:

  • Accessing or using information on the Website that proves inaccurate;
  • Inability (in whole or in part) to use the Website;
  • Accessing or using any information provided on any other page referenced by this Website.

7. Changes to the Terms and Conditions of Use

7.1. Darling Acoustics SRL reserves the right to revise these Terms and any other applicable terms at any time, without notice, by amending the relevant pages.
7.2. Users are responsible for checking the relevant pages to learn of any changes, which apply from the moment these Terms are updated.

8. Governing Law and Disputes

8.1. The rights and obligations of the parties mentioned in this document, as well as any legal effects thereof, are governed by the applicable laws of Romania.
8.2. Disputes arising from the interpretation or performance of these Terms will be settled by the competent courts of Râmnicu Vâlcea.
8.3. If any provision of this document is held invalid by a competent authority, the invalidity of such provision shall not affect the validity of the remaining provisions, which shall remain in force.
8.4. This document constitutes the entire agreement between the User and Darling Acoustics SRL regarding the use of lightfaber.eu.

9. Final Provisions and Contact

9.1. These Terms are supplemented by applicable legal provisions in force.
